The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following relief(s):-

“ 1. For issuance of writ in the nature of mandamus commanding and directing the respondents authorities to make the measurement of the land of the petitioner situated at Mauza Mhisaut alias Narkatiya, Anchal- Kushweswar Asthan East, bearing khata No. 157(old), 237 (new), Kheshra No. 101, 102 (old) 109, 243 (New).

1. (A) For issuance of any other writ/writs, direction, order/orders for which petitioner is found entitled to.”

2. After some argument, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file a petition in the prescribed Form No. 36 under Tenancy Rule 23(2)(i) of the Bihar Tenancy Act, 188 5 for measurement of his land, as in this regard the petitioner had simply filed an application but not in the prescribed Form No. 36.

3. Having considered the submissions and prayer made by the petitioner’s counsel, the instant writ petition stands disposed of as withdrawn, with the aforesaid liberty given to the petitioner.
