BATCH DISPOSAL (NAFR) - Nineteen connected writ petitions of 2009 (CWJC Nos. 14851, 15261, 15265, 15333, 15382, 15478, 15529, 15530, 15665, 15714, 15839, 15876, 15878, 15926, 15990, 16092, 16213, 16227 and 16443 of 2009), all relating to appointment of the petitioners at Class-III and Class-IV posts in Health Services, Government of Bihar, heard together before Dr. Anshuman, J. Counsel jointly submitted that the matter directly and substantially in issue had travelled to the Hon'ble Supreme Court and finally concluded on 17.10.2019 in favour of the State in State of Bihar v. Devendra Sharma, Civil Appeal No.7879 of 2019 (SLP (Civil) No.11885 of 2012), (2020) 15 SCC 466 : 2019 INSC 1157; paragraphs 29-46 of that judgment (reproducing, inter alia, Ashwani Kumar, Rita Mishra (FB Patna), R. Vishwanatha Pillai, Manshu Kumbhkar, Upendra Narayan Singh, Raghuwar Pal Singh, Nidhi Kaim, Jagdish Balaram Bahira and Umadevi (3), and setting aside the High Court order dated 12-7-2011 in State of Bihar v. Devendra Sharma, 2011 SCC OnLine Pat 1580, while upholding the order dated 24-9-2014 in State of Bihar v. P.S. Dhaka) were placed before the Court. Holding: in light of the discussions in that Supreme Court judgment, all the writ petitions have become infructuous and are dismissed as infructuous.
