In this writ petition the petitioners have mainly

challenged a common order dated 22.09.2010 and 23.09.2010 passed by the Chairman, Bihar Bhoodan Yagna Committee, Patna whereby as per petitioners the Chairman cancelled the parcha dated 7.02.2009 issued to the petitioners.

It is submitted by learned counsel for the respondent nos. 3 & 4 that the letter no. Ch/010-728 dated 22.09..2010 & 23.09.2010 containing the alleged orders did not come into effect nor became operational at any point of time and the same was also not communicated to the affected parties including the petitioners and owing to that reason the Chairman of Bhoodan Yagna Committee vide letter no. 369 dated 17.07.2015 directed the concerned District Bhoodan Yagna Committee to file an application before the Revenue Officer for making recommendation of the cancellation of parchas issued to the 88 persons including the petitioners under Section 21 of the Bihar Bhoodan Yagna Act 1954, although, the same is not under challenge. Learned counsel further submits that as the letter in question, which has been challenged, has never come into effect, so, the instant writ petition is not entertainable and has now become infructuous.

In view of the above stated facts this court finds no merit in this application, hence it stands dismissed.
