This is an application under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 filed by the father of the juvenile delinquent who was arrested in connection with Doriganj P.S. Case No. 92 of 2024 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

The prosecution case in short is that on 11^th April 2024 at about 2 o’clock at night police conducted a search to work out on information that some persons procured illicit liquor for trading. Police went to the place of occurrence and found four persons coming towards the place of motorcycle. Seeing police party, they fled away leaving the motorcycle. The

police identified the miscreants and stated their names in the FIR. From two motorcycles illicit liquor amounting to 25 ltrs. each were recovered, total being 50 ltrs. The juvenile delinquent was arrested on 2^nd January, 2025 and since then he is in protection home.

It is submitted by the learned Advocate for the petitioner/juvenile that considering the period of detention the juvenile delinquent may be released on bail.

This Court has perused the impugned order passed by the learned Special Judge, Children Court, Saran at Chapra in Criminal (Juvenile) Appeal No. 10 of 2025. The learned Judge has elaborately dealt with the SIR submitted by the Probation Officer against the juvenile delinquent. It appears from the paragraph no. 7 of the impugned judgment that the juvenile is a school dropout. He read up to class 5. Most of his friends are illiterate having nexus with criminal activities. The Probation Officer examined the neighbours of the juvenile and they reported that the juvenile is associated with a bad environment and he had previous antecedent too of selling liquor. He was arrested in connection with Doriganj P.S. Case No. 123 of 2023 for the same offence. Thus, the juvenile is a habitual offender dealing in the business of illicit liquor which is banned in the

State of Bihar.

Considering such circumstances and adverse report

against the juvenile, I am not inclined to release him on bail. The prayer for bail is thus, rejected.
