Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Sessions Trial No. 400 of 2022 arising out of Bhagwan Bazar P.S. Case No. 628 of 2021, lodged on 28.12.2021 under Sections 302 and 34 of the Indian Penal Code.

In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.

Speedy trial is a constitutional mandate of justice. For this reason, the Superintendent of Police, Saran at Chapra, is directed to take necessary action by instructing the concerned SHO/Investigating Officer to ensure the production of the charge-sheet witnesses before the Trial Court in connection with Sessions Trial No. 400 of 2022 arising out of Bhagwan Bazar P.S. Case No. 628 of 2021 at the earliest, so that the trial may be concluded within the specified period. This direction is issued as it transpires from the report that despite repeated efforts, witnesses have not been coming forward to adduce evidence in connection with Sessions Trial No. 400 of 2022 arising out of Bhagwan Bazar P.S. Case No. 628 of 2021.
