learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the recovery is of 130 liters of illicit liquor made from near the house of co-accused Kumkum Kumari.

Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the present case on the basis of suspicion and disclosure made by the local chowkidar. There is no recovery from the physical and conscious possession of the petitioner and the said recovery has been made

from an open space which is accessible to all. It is further submitted that the petitioner has been made an accused in the present case since she has criminal antecedent of the same nature. It is also stated that the petitioner is critically ill and has difficulty in walking and a medical prescription and report to the proceedings has been brought on record by way of Annexure-2 to the said application.

Learned APP for the State opposes the prayer of anticipatory bail application on the ground that there are as many as 6 criminal antecedents of the same nature, in response to the same, it has been submitted that the petitioner is on bail in all the cases.

At this stage, the petitioner has agreed to deposit a sum of Rs. 15,000/- in Mahavir Cancer Sansthan, Patna, bearing Account No. 3332964762, IFSC Code: CBIN0282779, Central Bank of India, Chitkohra Branch, Patna. The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of the aforesaid amount in the account of Mahavir Cancer Sansthan, Patna.

Considering the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within five weeks, be released

on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise, Patna City, in connection with Alamganj P.S. Case No.1089 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S., 2023 and and subject to the further condition that:-

(i) the petitioner shall co-operate in the investigation/trial.

(ii) the learned Court would, however, verify the criminal antecedent of the petitioner before releasing him on bail.

¶24

(iii) one of the bailors shall be a close relative/family member of the petitioner.
