Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in connection with Parbatta P.S. Case No. 240 of 2024 dated 12.06.2024 registered for the offences punishable u/s 302, 201, 304 B read with section 34 of the Indian Penal Code and 3 and 4 of the D.P. Act.

3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have strangulated the

informant's daughter to death due to non-fulfillment of demand of Rs. 10 lacs as dowry.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The petitioner no. 1 is bhaisur of the deceased and the petitioner no. 2 is Mukhiya of Lagar Panchayat . The petitioners neither demanded any dowry nor tortured the deceased. It is submitted that the deceased was not subjected to torture and cruelty soon before her death for or in connection with demand of dowry. As per para. 12 of the bail petitioner, the husband of the deceased is in custody since 02.07.2024. The petitioners have no criminal antecedent as stated in para 3 of the bail petition.

Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the prayer of anticipatory bail of the petitioners by submitting that the other co-accused person has already been granted regular bail by this court vide order dated 01.10.2024 passed in Cr. Misc. No. 63546/2024.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their

arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Parbatta P.S. Case No. 240 of 2024, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
