The present application has been filed for modification of order dated 05.03.2024 passed in Cr. Misc. No. 76914 of 2023, whereby and whereunder while granting anticipatory bail to the petitioners, it was stipulated that in the event of arrest or surrender before the court concerned within eight weeks from the date of order, the petitioners were to be released on bail.

Learned counsel for the petitioners submits that the petitioners used to work as labourer and went outside of State and due to gap in communication, the petitioners could not be informed about the condition of surrender within eight weeks

and for this reason they could not surrender within the stipulated time. Learned counsel further submits that further time of four weeks may be granted for surrender of the petitioners.

Having regard to the averments made in the petition as well as submission made on behalf of the petitioners, the order dated 05.03.2024 passed in Cr. Misc. No. 76914 of 2023 is modified to the extent that period of surrender of the petitioners is extended and petitioners are directed to surrender within four weeks from today, subject to payment of cost of Rs.3,000/- each by the petitioners to be deposited in the coffers of Patna High Court Legal Services Committee within two weeks from today.
