The petitioner apprehends arrest in connection with Mouzahidpur (Babarganj) P.S. Case No. 231 of 2023 instituted under Sections 326, 307, 302 of the Indian Penal Code and Sections 3, 4 and 5 of Explosive Substance Act.

As per the prosecution case, the petitioner is accused of blasting a bomb in the house of informant due to which his son died.

Learned counsel for the petitioner submits that the deceased died in a bomb blast in his own house. It has further been submitted that for the last twenty years, the petitioner is residing in Gajiabad and has been falsely implicated and he has

annexed the documents of his residing in Gajiabad.

Learned A.P.P. for the State opposes the prayer for

anticipatory bail of the petitioner.

Considering the fact that the deceased died in his house in bomb blast, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Mouzahidpur (Babarganj) P.S. Case No. 231 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
