ANTICIPATORY BAIL - GRANTED. Patna High Court (Sunil Dutta Mishra, J.), Criminal Miscellaneous No. 8591 of 2025, order dated 15-04-2025, arising out of Imamganj P.S. Case No. 240 of 2024, District Gaya, registered for offences punishable under Sections 317(5), 338, 336(3), 340(2) and 3(5) of the BNS. Allegation against the petitioner was that he handed over a stolen motorcycle to a co-accused for the purpose of sale; counsel for the petitioner submitted that he was innocent and falsely implicated on the basis of the confessional statement of the co-accused, that no incriminating article was recovered from his possession and that he had no criminal antecedent, and undertook to cooperate in the investigation; the learned APP opposed the prayer. The petitioner apprehends his arrest in connection with Imamganj P.S. Case No. 240 of 2024 registered for the offences punishable under Sections 317(5), 338, 336(3), 340(2) and 3(5) of the BNS.

Allegation against the petitioner is that he handed over the stolen motorcycle in the hand of co-accused for the purpose of sale.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of confessional statement of the co-accused. There is no material against the petitioner to show his involvement in the occurrence. No incriminating article has
