Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with NDPS No. 8 of 2024 arising out of Gidhaur P.S. Case No. 72 of 2024 instituted for the offence under Sections 411, 412, 414, 467, 467, 468, 471/34 of the Indian Penal Code, under Sections 25(1-B)a, 26/35 of the Arms Act and under Sections 8/20(B)(II) of the NDPS Act.

As per the prosecution case, the recovery is of 1 Kg 90 grams of Ganja, one automatic country made pistol, three live cartridges from the accused persons.

It has been submitted by the learned counsel for the petitioner that the recovery is not made from the petitioner and the petitioner is in custody since 9.9.2024. The name of the petitioner has come in the confessional statement of the coaccused.

Considering the aforesaid facts, this application
