grant of regular bail in connection with Sasaram (T) P.S. Case No. 724 of 2024 dated 29.08.2024 registered for the offences

punishable u/ss 319(2), 318(4), 338, 336(3), 336(4) of the BNS.

3 . As per the prosecution case, on 28.08.2024, one black colour Fortuner vehicle bearing Reg No. BR01FX0001 was fined by the traffic police and later on it came to the knowledge that the said number was being misused which was registered in the name of Addl Chief Secretary Planning and Development Deparment, accordingly the FIR was registered against the unknown said vehicle and its owner.

4 . Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioner, Deepak Kumar is the owner and the petitioner, Pawan Kumar is the driver of the said vehicle. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 15.09.2024.

5 . Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6 . Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of
