The petitioner seeks bail, apprehending his arrest, in connection with Garkha P.S. Case No. 151 of 2016, dated 21.05.2016, registered for the offences punishable under Section 366(A) of the Indian Penal Code.

As per allegation, a 17 year old daughter of the informant has been kidnapped by the petitioner and other coaccused with intent to marry her.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that except the petitioner, all other coaccused persons have already been enlarged on anticipatory bail by the Court below itself. He further submits that as a matter of

Kumar Singh @ Aman Kumar was in love with the alleged victim and the alleged victim on her sweet will came to him and got married. He refers to the statement of the alleged victim as recorded under Section 164 Cr.PC, as per which she has supported the submission as advanced by learned counsel for the petitioner. In her statement, she has clearly stated that about one and half months ago, she has voluntarily married the petitioner, because she was acquainted with him for the last two years and her parents were not ready for their marriage. Hence, the alleged victim left her home on 05.05.2016 and went to Delhi along with the petitioner and got married. He further submits that as per the assessment by learned Judicial Magistrate, the alleged victim is 18 years and half months old and as per medical opinion, her age has been assessed between 18 and 19 years.

It is also stated in paragraph no. 2 of the bail petition that the petitioner has not moved this Court earlier either for anticipatory bail or regular one in the instant case.

It has further been stated in paragraph no.3 of the bail petition that the petitioner has no criminal antecedents.

However, learned APP for the State vehemently opposes the prayer of the Petitioner for bail.

Considering the statement of the alleged victim and

her age, this petition is allowed, directing the petitioner, abovenamed, to be enlarged on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court Below, in connection with Garkha P.S. Case No. 151 of 2016, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023 and on the following conditions:

(i) In case, it is brought to the notice of the court below that the petitioner has any criminal antecedents other than the disclosed one, learned court below shall cancel the bail bonds of the petitioner after hearing him and getting satisfied that the petitioner has concealed his criminal antecedents despite his knowledge of the same.

(ii) In case, it is brought to the notice of the court below that statement regarding previous bail petition is wrong, learned court below shall cancel the bail bonds of the petitioner.
