In the present case, the petitioner seeks bail in connection with Muffasil P.S. Case No. 343 of 2024, registered for the offences under Section 302 of the Indian Penal Code.

As per the prosecution case, petitioner administered pesticide to her step-son of her second husband and to her daughters and also consumed the same but the step-son of the petitioner died and the petitioner and her daughters survived. The petitioner took the extreme step as she was being harassed by the recovery agents for the return of the loan taken by her first husband.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

falsely implicated in this case. The petitioner had been suffering from depression and did not understand the consequences of her act. The petitioner had been a victim of circumstances and she has been sufficiently penalized due to death of her step-son, as the child was from her second husband, the informant of this case. Learned counsel further submits that the petitioner is a lady and she undertakes to appear before the trial court as and when required and would not hamper the trial in any manner. Petitioner has got no criminal antecedent and she is in custody since 23.04.2024 and charge sheet has been submitted.

Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that there is specific allegation against the petitioner that she administered pesticide to her step-son as well as to her own daughters.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that petitioner is a lady and further considering submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya/concerned court, in

connection with Muffasil P.S. Case No. 343 of 2024, subject to the condition laid down under Section 437(3) of the code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
