Heard Mr. Ramji Kumar, learned counsel for the

petitioner and Mr. Sunil Kumar Pandey, learned APP for the State.

The petitioner has prayed for bail in connection with Ghoshi (Okari) P.S. Case No. 192 of 2022 registered for the offence punishable under Sections 420, 414 and 34 of the Indian Penal Code.

The case of the prosecution, in short, is that the stolen bikes were recovered from the possession of this petitioner. Other miscreants managed to escape. The name of this petitioner has surfaced in the disclosure of co-accused Chhotu Sharma.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has

been recovered from the possession of this petitioner. It has further been submitted that other co-accused person having similar nature of allegation whose name has surfaced in the confessional statement of the co-accused Chhotu Sharma has been granted bail by learned Co-ordinate Bench vide Cr. Misc. No. 62248 of 2022. Even Chhotu Sharma has been granted bail by learned Co-ordinate Bench vide Cr. Misc No. 36188 of 2022. The case of this petitioner stands on similar footing. He is languishing in judicial custody since 28.02.2025.

Learned APP appearing for the State has vehemently opposed the application for bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M. 1^st Class, Jehanabad in connection with Ghoshi (Okari) P.S. Case No. 192 of 2022.
