Heard learned Senior counsel for the petitioners,

learned APP for the State and learned counsel for the informant.

The petitioners apprehend their arrest in connection with Bibhutipur P.S. Case no.350 of 2024 registered under Sections 126(2), 115(2), 303(2), 74, 110, 118(1), 117(2), 352, 351(2) and 3(5) of the B.N.S, 2023.

As per the prosecution case, all eight F.I.R named accused persons including the petitioners herein came to the house of the informant variously armed and assaulted the

informant as well as the family of the informant.

Learned counsel for the petitioner submits that the petitioners are the ladies who have been falsely implicated in the case. There is general and omnibus allegation levelled against the petitioners of assaulting the informant’s aunty Ranjita Devi by lathi and danda . Due to some land dispute, the occurrence has taken place. So far as injury report of the victim Ranjita Devi is concerned, both injuries are simple in nature caused by hard and blunt substance, a copy of the injury report has been annexed with the case diary which is taken on record. The petitioners have no criminal antecedent and undertake to cooperate in the case/trial.

The application for anticipatory bail is opposed by learned A.P.P. for the State and learned counsel for the informant.

In view of the entire facts and circumstances of the case, it is directed that the petitioners above named, having no criminal antecedent in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bibhutipur P.S. Case no.350 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the

like amount each to the satisfaction of the learned S.D.J.M, Rosera, Samastipur, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
