Learned counsel for the petitioner submits that the petitioner’s prayer for bail has earlier been rejected twice first, vide order dated 18.04.2024 passed in Criminal Miscellaneous No. 11443 of 2024, and thereafter vide order dated 12.02.2025 passed in Criminal Miscellaneous No. 80098 of 2024. The petitioner is in custody since 18.10.2023.

Learned counsel further submits that the petitioner’s prayer for bail was lastly rejected on 12.02.2025 after perusal of the report of the trial court, wherein it was indicated that out of five charge-sheet witnesses, four witnesses and one seizure-list witness had been examined, and the trial court expected that the trial would be concluded within three

months.

Learned counsel further submits that although the said order was passed on 12.02.2025, the trial has not been concluded till date.

Learned counsel for the State opposes the prayer for bail and submits that the trial shall be concluded soon.

Under these circumstances, it appears to this Court that no useful purpose would be served by keeping the petitioner in custody. Accordingly, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned Additional Sessions Judge, 1^st , Bhagalpur in connection with Tatarpur P.S. Case No. 271 of 2023, subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
