Heard learned counsel for the petitioner and learned

The petitioner seeks bail in connection with Kotwali (Jogsar) P.S. Case No. 796 of 2023 instituted for the offences under Sections 376D, 120B, 34 of the Indian Penal Code and Section 4/6 of the POCSO Act.

Prosecution case, in short, is that the accused persons including the petitioner committed rape upon the victim.

Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and

omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.08.2023 and has no criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that given the nature and gravity of offence, the petitioner does not deserve to be released on bail. Learned APP further submitted that the prayer for grant of bail to the co-accused person has already been rejected by this Court vide order dated 06.02.2024 passed in Cr. Misc. No. 72165 of 2023.

Considering the aforesaid facts and circumstances of the case as also nature and gravity of offence, this Court is not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.

Learned Trial Court is directed to expedite the trial.
