Heard learned counsel for the petitioners and

learned APP for the State.

¶21

The petitioners apprehend their arrest in connection with Bettiah Muffasil P.S. Case no.169 of 2025 registered under Sections 126(2), 127(2), 115(2), 118(1), 109(1), 352, 76 and 3(5) of the B.N.S, 2023.

As per the prosecution case, on 22.03.2025 at about 10:00 p.m. all F.I.R named accused persons including the petitioners herein came to the shop of the informant variously

armed and started abusing the informant. On protest, accused Guddu Ansari gave a knife blow on the head of the informant causing head injury to him. It is further alleged that other accused also indulged in the assault.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. The specific allegation of assault is upon Guddu Ansari who gave a knife blow on the head of the informant, however, the injury report shows that the injury is simple caused by hard and blunt object, a copy of the injury report has been annexed as Annexure-P/3 to the application. So far as petitioner nos.1 to 4 are concerned, there is general and omnibus allegation of assault on them. The petitioners undertake to cooperate in the case/trial.

The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the aforesaid facts of the case and considering that there is general and omnibus allegation levelled against the petitioners and also considering that nature of injury is simple in nature, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bettiah

Muffasil P.S. Case no.169 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
