Heard Mr. Basant Kumar Singh, learned counsel for the petitioner and Mr. Raju Kumar, learned counsel for the informant as also Mr. Sohammad Sufyan, learned APP.

The petitioner is in custody in connection with Dinara P.S. Case No. 296 of 2024 for the offence punishable under sections 126(1), 109, 3(5) and 118(2) of the Bharatiya Nyaya Sanhita and section 27 of the Arms Act lodged on 03.07.2024 by the informant, Saurabh Kumar Singh.

As per the prosecution story, the informant alleged that on minor issue of dumping of soil, the petitioner started assaulting his son. The locals pacified the matter and his son returned but on the same day, both this petitioner and one Mangaru Sah entered his house and once again, the assault took place.

Earlier, the bail of the petitioner was rejected vide order dated 13.02.2025 in Cr. Misc. No. 82468 of 2024 and this is the second attempt.

Learned counsel for the petitioner submits that he has already suffered by being in custody since 08.07.2024, the trial is not likely to be concluded soon and if granted relief, shall be diligently appearing in trial without influencing the witnesses.

Learned APP as also learned counsel for the informant opposes the prayer submitting that he played an important role which led to the grievous injury to the informant’s side.

Allegation is there, the petitioner has remained in custody since 08.07.2024, the trial has not concluded and an undertaking has been given that he shall be diligently appearing in trial without influencing the witnesses, in that background, this Court is inclined to extend him the privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Rohtas at Sasaram in connection with Dinara P.S. Case No. 296 of 2024 subject to the following conditions:

(i) one of the bailor should be the family

member/relative of the petitioner who shall provide official document to show his/her bona fide;

¶22

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned police station every month for six months to mark his attendance and after the end of the period, the certificate shall be submitted before the Trial Court failing which steps shall be taken for the cancellation of the bail bonds;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.
