Heard learned counsel for the petitioner and learned APP for the State.

In the present case, the petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 559 of 2024 registered for the alleged offences under Sections 308(3), 308(4) and 308(5) of B.N.S., 2023.

As per prosecution case, the allegation against the petitioner is threatening the informant with life and demand of extortion money of Rs.Ten lakhs and a piece of land.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. The informant is himself accused in Hajipur Sadar P.S. Case No. 36

of 2024 registered under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act for the murder of brother of the informant, namely Bipin Rai @ Karu Rai and the present case has been lodged only to pressurize the petitioner. Learned counsel further submits that, moreover, no extortion money was paid to the petitioner. There is no cogent material on record to show complicity of the petitioner in the said occurrence. The petitioner is in custody since 09.06.2025 and charge sheet has been submitted. The petitioner is having antecedent of seven cases and he is on bail in all such cases.

Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner appears to be habitual offender.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of accusation and also considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/concerned Court in connection with Hajipur Sadar P.S.
