the petitioner, Mr. Kameshwar Singh, learned counsel for the Informant and Ms. Suman Kumari Singh, learned APP for the State.

2. The petitioner seeks regular bail in connection with Patrakarnagar P. S. Case No. 548 of 2024, dated 25.09.2024, registered for the offences punishable under Sections 376, 504, 506 and 34 of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the informant, so-called victim is a distant relative of the petitioner and admittedly she was a major girl

when the alleged sexual relationship between the petitioner and her started and the same is alleged to have started in the year 2018 but the FIR was lodged by her in the year 2024 that too several months after the last alleged physical relationship. It is further submitted that the informant, the victim denied to undergo medical examination during the investigation, in fact the petitioner being a relative of the informant provide her monetary help and transferred a total amount of Rs. 8,26,552/to her on several occasions through different modes out of which a sum of Rs. 3,33,005/- was returned but the remaining amount was not returned consequently the petitioner sent a legal notice to the informant a copy of which has been filed with this petition and thereafter the informant proceeded to lodge the FIR only with malafide intention and with a revengeful attitude. It is lastly submitted that the petitioner bears no criminal antecedent and languishing in jail since 21.05.2025 against him the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. In the facts and circumstances of the case and considering the above submissions and mainly the fact that it is an admitted position that the victim was a major and entered

into physical relationship with the petitioner when she was a major girl and remained in such relationship for several years and there is also a money transaction dispute in between the petitioner and the informant as noted above, coupled with the completion of investigation against him, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Patrakarnagar P. S. Case No. 548 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
