Heard learned counsel for the petitioner, learned APP for the State and perused the case diary. Despite valid service of notice, none appears on behalf of the informant.

The petitioner seeks bail in connection with Sindhugarh P.S. Case No. 107 of 2024, instituted for the offences punishable under Section 96 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that the petitioner along with other co-accused person has kidnapped informant’s minor sister.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case.

Learned counsel for the petitioner also submits that there is delay of five days in lodging the FIR without any plausible explanation. It is next submitted that the victim has not mentioned anything against the petitioner in her statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is further submitted that the medical report does not corroborate with the prosecution case. The petitioner is in custody since 27.10.2024 and has got no criminal antecedent.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sindhugarh P.S. Case No. 107 of 2024.
