The petitioner seeks regular bail in connection with

Sessions Trial No. 1058 of 2025 arising out of Maner P.S. Case No. 274 of 2024 lodged on 29.04.2024, for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 22.01.2025 passed in Cr. Misc. No. 558 of 2025. Counsel submits that in the present case vide order dated 28.11.2025, the petitioner was directed to file a supplementary affidavit along with supportive documents demonstrating that the petitioner is

not absconding in any of the cases pending against him which are six in numbers. Counsel submits that the said supplementary affidavit has been filed in which it has been categorically stated that the petitioner is not absconding in any of the cases pending against him. He submits that in Maner P.S. Case No. 345 of 2019, the petitioner is on bail and awaiting for final form and charge-sheet; in Maner P.S. Case No.189 of 2020, the petitioner is on bail and final report has been submitted; in Maner P.S. Case No. 571 of 2020, the petitioner is on bail and the chargesheet has been submitted against two accused persons and in respect of rest accused including the petitioner, investigation is still pending; in Maner P.S. Case No. 704 of 2022, the petitioner is on bail and awaiting for final form as well as charge-sheet and investigation is pending; in Maner P.S. Case No.414 of 2022, police has submitted final form and found the case untrue; in Maner P.S. Case No.435 of 2023, the petitioner is on bail which is pending for hearing on the point of cognizance and in the present case i.e. Maner P.S. Case No. 274 of 2024, the petitioner is in judicial custody.

Learned counsel for the petitioner submits that in this way, the petitioner has explained about all the cases pending against him. He submits that in the present case, charge has been

framed and case is pending for adducing evidence. He submits that vide order dated 19.09.2025, a report with regard to the present stage of trial has been called for. He further submits that one of the co-accused has been granted anticipatory bail by this Court vide order dated 11.04.2025 passed in Cr. Misc. No.14097 of 2025.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that the bail application of two co-accused persons was rejected by the Co-ordinate Bench of this Court vide order dated 02.07.2025 passed in Cr. Misc. Nos. 6553 of 2025 & 19056 of 2025 respectively, directing the Senior Superintendent of Police, Patna to restore the police protection of the informant who is a 18 year old boy in which he is the eye witness in killing of his father and now, eye witness of killing of his uncle.

Learned A.P.P for the State opposes the prayer for bail and submits that bail application of two co-accused persons was rejected with consideration to provide police protection to the informant.

It is made clear and hereby specifically directed to the Senior Superintendent of Police, Patna, to provide police protection to the informant of this case until his evidence is

adduced before the concerned trial court.

¶26

In the present facts and circumstances of this case, the present petitioner shall be released on bail only after completion of the informant’s evidence in all the Sessions trial arising out of Maner P.S. Case No. 274 of 2024 on the conditions imposed by the trial court himself, so that the petitioner shall not evade his appearance further during evidence of other prosecution witnesses.

Accordingly, with the aforesaid observation and direction, the present bail application stands disposed off.
