Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 21(b), 25 of the N.D.P.S. Act.

The allegation in the First Information Report is that a consignment of cough syrup with codeine content totaling to 735 litres were recovered from a Bolero pick-up which was parked near the wooden house of the petitioner. It has further been stated that three persons had managed to flee away and the apprehended person disclosed his name as Chintu Prasad.

Learned counsel for the petitioner submits that the consignment of the cough syrup does not belong to the present petitioner and he is no way concerned with the said consignment. His name has surfaced in the present case only on

the basis of the fact that the said Bolero pick-up was parked near the wooden house of the present petitioner. The petitioner had no knowledge whatsoever about the contents of the consignment and nothing worthwhile has been collected during the course of investigation as against the present petitioner. It has also been submitted that the petitioner is an old man aged about 71 years with no criminal antecedent and he is languishing in custody since 06.12.2024.

Learned APP for the State has opposed the application for anticipatory bail.

Considering the facts and circumstance of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahalgaon P.S. Case No. 117 of 2024.
