The petitioner seeks bail in a case registered for the offence punishable under Sections 137(2) and 96 of the BNS.

As per the prosecution case, allegation in the FIR is that the daughter of the informant went missing from the house and they came to know that six accused persons had kidnapped the daughter who are named in the FIR.

Learned counsel for the petitioner submits that the name of the petitioner does not figure in the FIR among six persons and it would be evident from the statement of the victim recorded under Section 183 of the BNSS that the victim had left the house on her own will and went with the petitioner and that she was known to him for the past two years and statyed with

him for 7-8 months. It has further been submitted that the victim girl is a an adult and the certificate to such effect has been brought on record by way of Annexure-P2. Petitioner is in custody since 17.05.2025 with no criminal antecedent.

Learned APP for the State opposed the grant of bail on the basis of allegations made in the first information report.

6.Taking into consideration the facts and circumstances and also considering the fact that the petitioner is a young boy of 19 years of age and is in custody since 17.05.2025, chargesheet has already been submitted, coupled with the fact that no allegation of any sexual assault etc., has been made by the victim against the petitioner rather, there appears to be a love relationship, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1^st Class, Saran at Chapra in connection with Rivilganj P.S. Case No. 151 of 2025.
