Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

The petitioner seeks bail in connection with Fatuha P.S. Case No. 191 of 2024 dated 27.03.2024 registered for the offences punishable under Sections 341, 323, 307, 302 read with Section 34 of the I.P.C. and Section 27 of the Arms Act.

As per the prosecution case, on 26.03.2024, a scuffle took place between the informant’s nephew Lal Krishna Kumar and his villager Ranjeet Singh (petitioner) on the eve of Holi and thereafter the matter was settled. It is further alleged that on 26.03.2024 at about 1.00 P.M., the petitioner and other accused

persons were sitting on the Dalan of Nawal Singh with weapons and when the informant’s brother Krishna Nandan Singh reached near the said Dalan then Ranjeet Singh (petitioner) with an intention to kill, assaulted with iron rod on his head, as a result of which, his head was broken and other accused persons have also assaulted with lathi, danda and bricks and when his son Ritesh Kumar @ Balli came to save him, he was also assaulted by the accused persons with iron rod, lathi and danda, as a result of which, he also sustained injury. They also fired but due to fear, none of the villagers has come at the place of occurrence. The injured were brought to Government Hospital, Fatuha and from where they were referred to P.M.C.H., Patna where in course of treatment, the informant’s brother Krishna Nandan Singh died and treatment of Ritesh Kumar @ Balli is going on.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. There is no specific allegation of assault on the deceased against the petitioner. There is general and omnibus allegation against the petitioner. There is case and counter case between the parties. The petitioner has no concern with the allege occurrence. It is further submitted that the other co-

accused person, Sugriv @ Sugreev @ Chitranjan Kumar has already been granted bail by a Bench of this Court in Cr. Misc. No. 2172 of 2025 vide order dated 02.04.2025. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 08.05.2024.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for bail petition of the petitioner. Learned counsel for the informant has further submitted that there is direct allegation against the petitioner for assaulting on the head of the informant’s brother with an iron rod, due to which, he died. He further submits that the case of other accused person, Sugriv @ Sugreev @ Chitranjan Kumar who has been granted bail is not on identical footing to the case of the petitioner.

Considering the aforesaid facts and circumstances of the case and finding substance in the contention of the learned counsel for the informant, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Fatuha P.S. Case No. 191 of 2024, pending in the court of learned A.C.J.M.-Ist, Patna City, Patna.
