The petitioner seeks regular bail in a case registered under Sections 363, 366A, 504, 506, 34 of the Indian Penal Code and Sections 8 and 17 of the POCSO Act.

As per the prosecution case, it is alleged that this petitioner kidnapped the minor granddaughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. Further submission is that petitioner is a young boy of 22 years and due to love affairs, the victim has herself left her house, and with consent of her parents, she

solemnized marriage with the petitioner. The victim and the petitioner have been blessed with a male child and they are living happy conjugal life. The victim is major. Petitioner has clean antecedent and there is no chance of his absconding or tampering with the evidence. The charge-sheet has already been submitted after completion of investigation. Petitioner is in custody since 06.06.2025 and he undertakes to cooperate in the trial.

Learned counsel for the informant and learned A.P.P. for the State have not opposed the bail of the petitioner and submitted that the victim after marriage with the petitioner is leading happy conjugal life with him.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Tajpur P.S. Case No.119 of 2023.
