The petitioner seeks regular bail in connection with Gaurichak P.S. Case No.195 of 2025 (P.T.N. No.612 of 2025), registered for the offences punishable under Sections 30(a), 32 & 34 of the Bihar Prohibition and Excise Act.

As per the prosecution case, there is recovery of 652.32 liter foreign liquor from a Pickup Parcel Van bearing Registration No. BR-07-GB-8490.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is neither owner nor driver of the vehicle in question from where the alleged liquor was seized. Learned counsel submits that no incriminating

article has been recovered from the conscious possession of petitioner. He further submits that petitioner was arrested only on the basis of suspicion as at that time he was going to meet his uncle. Learned counsel submits that petitioner is in custody since 16.04.2025, having clean antecedent. He further submits that there is no chance of absconding the petitioner or tampering with the evidence and he undertakes to cooperate in the investigation and trial.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City, Patna in connection with Gaurichak P.S. Case No.195 of 2025 (P.T.N. No.612 of 2025).
