Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Ramkrishna Nagar PS Case No. 96 of 2024 dated 01-02-2024 instituted for the offence punishable under Sections 395 of the Indian Penal Code and Sections 25((1-B)a/26/35 of the Arms Act.

This is the second attempt of the petitioner for grant of bail. Earlier the bail application of the petitioner was rejected vide order dated 25.09.2024 passed in Criminal Miscellaneous No. 49215 of 2024.

Allegation against the petitioner with other coaccused persons is of committing dacoity in a pre-planned manner in the house of the informant in broad daylight. It is

further alleged that local people immediately informed about the incident on police mobile No. 112 and the police took immediate action and reached the spot and apprehended two injured criminals at 18.40 PM and admitted them in Nalanda Medical College Hospital, Patna. It is further alleged that Sonu Kumar (petitioner) was apprehended with a country made pistol.

Learned counsel for the petitioners submits that the petitioner is innocent and he has been falsely implicated in the case. It is submitted that the petitioner namely, Sonu Kumar was not arrested at the spot rather he has been remanded in the case after 21 days of the alleged occurrence. It is further submitted that the petitioner was admitted in NMCH on the alleged date of occurrence, but there is neither any admission register nor discharge summary report available in the case diary. It is submitted that till date no TIP has been conducted. The investigation has already been completed. Lastly, it has been submitted that petitioner, namely, Sonu Kumar, is in custody since 08-02-2024 and one case is pending against him.

Learned APP for the State vehemently opposed the prayer for bail and there is material available against petitioner in the case diary to connect their complicity in the commission of offence. Therefore, this Court is not inclined to enlarge the

petitioner on bail.

Accordingly, the prayer for bail of the petitioner is

hereby rejected.

However, the learned Trial Court is directed to expedite the trial and take all endeavour to conclude the trial at the earliest, preferably, within a period of six (06) months from the date of receipt or production of a copy of this order by fixing the case day to day basis, if necessary. In the event, the trial is not proceeding due to absconding accused person(s), the trial court may separate trial of the petitioner to conclude the trial within stipulated period of time.
