Heard learned counsel for the petitioner, learned

APP for the State and perused the case diary.

The petitioner seeks bail in connection with Bairgania P.S. Case No. 110 of 2024, instituted for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The prosecution case, in short, is that, daughter of the informant went to market and did not return. Later, the family learnt through social media about a dead body near ‘Shiv Shakti Gas Godown’, which was confirmed to be of the dead body of her daughter. She was allegedly murdered by unknown person.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the petitioner is not named in the FIR. Name of the petitioner has transpired in this case during course of investigation. It is further submitted that the petitioner has confessed his guilt before the police and the same has got no evidentiary value. The petitioner is in custody since 04.07.2024 and has got no criminal antecedent.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner and submits that the petitioner has confessed his guilt and has stated that he along with co-accused person has committed murder of his wife and thrown away the dead body. It is further submitted that there is specific allegation levelled against the petitioner of committing murder of the deceased. Hence, the petitioner does not deserve the privilege of bail.

Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.
