The petitioner apprehends arrest in

connection with Sono P.S. Case No.374 of 2023 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

As per FIR, there is recovery to total 100 liters of illicit liquor from the sacks tied with the motorcycle of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that the petitioner was not arrested on the spot and nothing has been recovered from

conscious physical possession of this petitioner. It is submitted that the petitioner has no concern with the alleged motorcycle as well as illicit liquor.

Learned APP appearing on behalf of the State, opposes the prayer of bail of the petitioner.

In view of the submissions, as made above and nature of allegation and as the recovery of illicit liquor has been made from the possession of the petitioner and he is also involved in two other cases of similar nature, this Court is not inclined to grant bail to the petitioner, at present.

Accordingly, the prayer of bail of the petitioner is rejected herewith.
