Petitioner seeks regular bail in connection with Kalyanpur P. S. Case No. 230 of 2021 in a case registered for the offence punishable under Section 302 of the Indian Penal Code.

Allegation against petitioner is that he assaulted and electrocuted the son of informant on account of land dispute. Post-mortem report goes to show multiple injuries on the person of deceased.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, deceased went on the street of petitioner and unknowingly stepped upon the open electric wire. Petitioner

claims clean antecedent and is in custody since 25.11.2023.

However, learned A.P.P. for the State vehemently

opposed the bail application.

Considering the nature of accusation and the fact that multiple injuries were found on the person of deceased, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 25.11.2023, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
