Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court was inclined to enlarge the petitioner on bail and directed that the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Patna in connection with Chitragupta Nagar P.S. Case No. 14 of 2024.

Deepak Chaudhary @ Krishna Kant Chaudhary sought bail in Chitragupta Nagar (Patna) P.S. Case No. 14 of 2024, registered under Sections 109(2), 3(5) and 61(2) of B.N.S. and Section 27 of the Arms Act, arising from allegations that, amid a telephone-mediated dispute over gold kept by one Gaurav and Rs. 8 Lakh, a masked man came to the office and fired at the informant's chest. Heard Mr. Awadhesh Kumar, learned counsel for the petitioner and Mr. Sanjay Kumar Pandey, learned APP for the State.

The petitioner has prayed for bail in connection with Chitgragupta Nagar P.S. Case No. 14 of 2024 registered for the offence punishable under Sections 109(2), 3(5) and 61(2) of B.N.S. and Section 27of the Arms Act.

The case of the prosecution, in short, is that four days ago when the informant was in Ranchi, then Ujjawal, Gaurav, Anshuman and driver Vivek Mishra had called him over the telephone and asked for arranging meeting in his office. But when he returned Patna, no one contacted him. It has further been stated that in the evening at 7:00, he further alleged that

Gaurav kept his gold and Rs. 8 Lakh. Ujjawal said Gaurav to return the money over phone, then he said that the gold belonged to him and it must be returned to him. On that, Gaurav abused him and said that he will not return the gold. It is further alleged that in the office a man bearing mask came there and after some time he made a fire at his chest.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. it is clear that the name of the petitioner is not there in the F.I.R., During course of investigation, this petitioner has given his confessional statement and in his confessional statement, he has stated that he was directed by the informant himself to make fire at him. Learned counsel for the petitioner has also submitted that in this case, the informant himself has been made accused by the police. Save and except the confessional statement, there is nothing against this petitioner. He is languishing in judicial custody since 26.09.2024.

Learned APP appearing for the State has vehemently opposed the application for bail has submitted that petitioner is having criminal antecedent of one case.
