The petitioner is apprehending arrest in connection with Charkapathar P.S. Case No. 69 of 2024, dated 17.08.2024, lodged under Section 103(1), 238, 61(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as “BNS, 2023”), pending before the Court of A.C.J.M-II, Jamui.

As per the prosecution, FIR has been lodged against four named accused persons, including the present petitioners, alleging that all the accused persons, in connivance with each other, killed his son, and thereafter the present case was lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that, on the basis of suspicion, the petitioner’s name has

been figured in this case, and there is not a single eyewitness. He also submits that the petitioner has a clean criminal antecedent and, save and except suspicion, there is nothing specific against the present petitioner. Additionally, he submits that during the investigation, the IO of this case has found nothing.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that in the confessional statement of the co-accused Jabbar Sheikh, he himself narrated the entire story as to why and how they killed the informant’s son.

In the present facts and circumstances, and particularly when involvement is accepted in the confession, this Court is not inclined to grant anticipatory bail to the petitioner, as the matter relates to murder. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
