Heard learned senior counsel for the petitioner and

learned APP for the State as well as learned counsel for the informant.

In the present case, the petitioner seeks bail in connection with Barauni P.S. Case No. 166 of 2024 registered for the offences under Sections 324, 326 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, petitioner and other coaccused persons called out the informant and the petitioner fired upon him and the shot hit the informant who fell down. Coaccused fired in the air and fled away from the spot.

Learned senior counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

falsely implicated in this case. No occurrence as alleged has ever taken place. Nothing incriminating has been recovered from the person or possession of this petitioner. From the narration of the FIR, it is clear that there was no intention to kill the informant otherwise nothing could have prevented the petitioner and his associates from killing the informant. Petitioner is in custody since 27.02.2025 and charge-sheet has been submitted. Petitioner is having antecedent of 5 cases but he is on bail in all these cases.

Learned A.P.P. as well as learned counsel appearing on behalf of the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the informant submits that opening fire upon the informant shows the intention of the petitioner and the informant could have lost his life in this firing.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of chargesheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Begusarai/concerned court in

connection with Barauni P.S. Case No. 166 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by

the court concerned.
