Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Katra P.S. Case No. 53 of 2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 127(2), 223, 121(2), 132, 174, 262, 117(2), 115(2), 109, 303(2), 62, 324(4), 324(5), 125, 61(2), 352(2) and 351(4) of the BNS.

Allegedly the petitioner along with 36 named persons and 80-100 unknown persons surrounded the police station and pelted bricks and stones, due to which the informant and other police constables have sustained serious injuries. The entire occurrence was video-graphed and from the video, local

chaukidar identified the petitioners and others.

Learned Advocate for the petitioners contended that in fact only on account of the petitioners being local resident and present at the place of occurrence, their names have been implicated in this case. There is omnibus nature of allegation against 36 named accused persons, including the petitioners, and 80-100 unknown persons. However, the video, based upon which identification has been done, did not confirm with the provisions of Section 65(B) of the Indian Evidence Act. It is further contended that one Surendra Chaudhary, having identical allegation, he has been extended the privilege of anticipatory bail in Cr. Misc. No. 50715 of 2025. The case of the petitioners is based on parity. It is lastly contended that both the petitioners did not have any criminal antecedent and they undertake that they will fully co-operate in the proceeding of the Court. So far the injury sustained to the police personnels are concerned, all of them have been found to be simple in nature.

On the other hand, learned counsel for the State opposed the pre-arrest bail application and submits that the petitioners have caused obstruction in discharging the official duty and ransacked the police station and assaulted the personnels.

learned Advocate for the respective parties and taking note of the omnibus nature of allegation, coupled with the fair antecedent, as also the fact that the case of the petitioners is based on parity, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, Muzaffarpur in connection with Katra P.S. Case No. 53 of 2025, subject to the conditions laid down in Section 482(2) Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners.
