Heard Mr. Kumar Ravish, learned counsel for the petitioner, Mr. Choubey Jawahar, learned APP for the State and perused the case diary.

The petitioner seeks bail in connection with Palasi P.S. Case No. 84 of 2024, instituted for the offences punishable under Section 304(B) of the Indian Penal Code read with Sections 3 and 4 of Dowry Prohibition Act.

The prosecution case, in short, is that the petitioner assaulted informant’s daughter for non-fulfillment of dowry and caused her death by strangulation and later hanged her body.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case.

Learned counsel for the petitioner also submits that the petitioner is husband of the deceased. It is also submitted that death of the deceased did not occur at the matrimonial house rather it took place at the house of deceased’s maternal uncle ( mausa ) where she had been residing separately. The petitioner was not present at the place of occurrence. It is further submitted that the deceased had illicit relationship with another person due to which she has committed suicide. The petitioner is in custody since 07.05.2025 and has got no criminal antecedent.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner and submits that there is specific allegation against him of demanding dowry and committing murder of informant’s daughter. It is further submitted that on perusal of post-mortem report, it transpires that no external injury has been found on the body of the deceased and cause of death has been opined as asphyxia due to hanging. Hence, the petitioner does not deserve the privilege of bail.

Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.
