No. 23 of 2025 registered for the offences punishable under Sections 372 373, 376, 386, 498A, 504, 506, 34 of the Indian Penal Code and Section 3 and 4 of DP Act, Section 3 and 4 of the Muslim Women (Protection of Rights on Marriage) Ordinance, 2018, and Section 5 of Immoral Traffic (Prevention) Act, 1956.

FIR is founded upon Complaint Case no. 575C of 2024 filed before learned CJM, Khagaria, wherein it is alleged that petitioner alongwith husband of the daughter of the complainant, creates an impression that this petitioner was in illicit relationship with her daughter which may help the husband of her daughter to get divorce from her daughter. The complainant is the mother of the victim. The allegation of dowry demand is also available, which was for Rs. 5 lakhs and 50 grams gold. The mother of the victim alleged to force her daughter to join prostitution.

It is submitted by learned counsel appearing on behalf of the petitioner that apparently this petitioner is the cousin brother of the complainant and the present allegation raised in the background of dowry demand. It is submitted

that the impression of illicit relation alleged through complaint is only out of presumptions. It is pointed out that even as per the complaint, no allegation of rape is available against this petitioner. While concluding arguments, it is submitted that petitioner is a man of clean antecedent.

taking note of fact as allegation of rape is prima-facie not appears to available against this petitioner, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Khagaria/ concerned Court, where the case is pending in connection with Morkahi P.S. Case No. 23 of 2025, subject to

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner implicated with present case only being the mother-in-law of the daughter of the complainant/ informant. It is pointed out that save and except omnibus type of allegation as to help co-accused namely, Md. Tausif who is the son-in-law of the complainant, nothing incriminating appears available against this petitioner, who is a lady of clean antecedent.
