Patna High Court (Prabhat Kumar Singh, J.), by order dated 07-11-2025 in Criminal Miscellaneous No. 50379 of 2025, allowed the prayer for regular bail of Kamlesh Ravidas, arraigned with the FIR-named accused in Halsi Police Station Case No. 299 of 2024 (District Lakhisarai) for offences punishable under sections 103(1) and 238 of the Bharatiya Nyaya Sanhita, 2023. The prosecution case, as recorded, was that on account of a dispute over a pathway, all the FIR-named accused including the petitioner strangled the informant's mother to death and thereafter disfigured her face. Petitioner seeks regular bail in a case registered for the offence punishable under sections 103(1) and 238 of the Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, due to dispute with regard to pathway, all the FIR named accused persons including this petitioner killed mother of the informant by strangulation. Thereafter, they disfigured face of the deceased.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Informant is not eye witness of the occurrence and only on account of previous dispute, petitioner has been made accused in this case on the basis of suspicion.

F.I.R. has been lodged after inordinate delay of 19 days without any explanation which renders the entire prosecution case doubtful. Learned counsel submits that save and except suspicion, there is no other direct or indirect evidence against the petitioner to show his complicity in the occurrence. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 4.3.2025.

Learned counsel for the State and the informant oppose the prayer for bail.

Considering the nature of accusation and period of custody of the petitioner, his prayer for regular bail is allowed.
