At the outset, learned counsel for the petitioners submits that the instant matter has been listed under the wrong heading ‘For Orders (On Office Notes)’ and it ought to have been listed under the heading ‘For Admission’ and the same may be heard.

2. Heard Mr. Aman Vishal, learned counsel for the petitioners and Mr. Abhay Kumar, learned APP for the State.

3. Petitioners seek regular bail in connection with Nabinagar P.S. Case No. 121 of 2025 dated 20.04.2025 registered for the offence punishable under section 303(2) of the Bharatiya Nyaya Sanhita.

counsel are that the major offence for which the FIR has been registered relates to the theft of a tractor of the informant and during the course of investigation, the alleged stolen tractor was recovered from the possession of two co-accused persons, namely, Anil Sharma and Shubham Kumar and not from the possession of the petitioners and the names of the petitioners surfaced in the CDR/SDR details during the investigation and they have been made accused on the basis of their own confessional statement, which has no evidentiary value and in the subsequent part of the occurrence, the petitioners were not involved and no role, as alleged, was attributed to them. It is lastly submitted that the petitioners have been languishing in jail since 18.05.2025 and the investigation has been completed against them and the alleged offence is triable by the court of any Magistrate.

5. Learned APP for the State has opposed the prayer of the petitioners.

6. Considering the aforesaid submissions and mainly the petitioners’ custody period and completion of investigation against them, this Court is inclined to release them on bail. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the
