2. The petitioner has preferred this application for grant of regular bail in connection with Tajpur P.S. Case No. 134 of 2024 dated 26.04.2024 registered for the offences punishable u/ss 363 of the Indian Penal Code and subsequently, Sections 302, 201 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, on 25.04.2024, during a marriage ceremony in the neighborhood of the informant, his son namely, Arvind Kumar aged about 6 years was at home until

the Jaimala program. After returning from the barat's dinner, the informant did not find his son at home. The informant searched for his son in the neighborhood but his son was not found. Consequently, an FIR was lodged against unknown miscreants.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Raja Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The charge-sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.01.2025.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that during the course of investigation, the name of the petitioner has surfaced in this case on the basis of the statement of the coaccused, Raj Kumar Das in para 48 of the case diary in which he confessed his involvement and the involvement of the other accused persons including the petitioner in the alleged offence.

It is further submitted that the petitioner in connivance with the co-accused made a call for demanding ransom from the deceased's father after his death.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Tajpur P.S. Case No. 134 of 2024 with the condition :-

(i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
