Case No. 4 of 2025, instituted on the written report of informant Shashikant Prasad under Sections 103(1) and 61(2) of the BNS and Section 27 of the Arms Act against five accused persons including the petitioner. Prosecution allegation: on 03.01.2025 at around 8 P.M. the deceased Sri Kant Patel (informant's brother) went out with the petitioner, who at 8:30 PM phoned the informant that Sri Kant Patel was admitted in Sadar Hospital, where the informant found him lying dead. Counsel for the petitioner urged false implication due to previous enmity, mere suspicion, absence of eye-witnesses, and no recovery of incriminating articles from the petitioner's possession or house; petitioner stated to be of clean antecedent and in custody since 05.01.2025. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Chapra Town P.S. Case No. 4 of 2025 instituted for the offences punishable under Sections 103(1), 61(2) of the BNS and Section 27 of the Arms Act.

As per the prosecution case, the petitioner and others are accused of committing the murder of the deceased.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of mere suspicion. He submits that petitioner has been falsely implicated in this case due to previous enmity. He further submits that there is no eye witness to the occurrence. possession of the petitioner or from his house. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 05.01.2025.

From perusal of the FIR, case diary, postmortem report and the impugned order of the learned Additional Sessions Judge-VI, Saran at Chapra dated 30.04.2025, it appears that on the basis of written report of the informant Shashikant Prasad, FIR has been registered under Sections 103(1), 61(2) of the BNS and Section 27 of the Arms Act against five accused persons including the present petitioner. The allegation against the petitioner is that on 03.01.2025 at around 8 P.M. brother of the informant namely Sri Kant Patel went outside with his brother namely Ravi Shankar Kumar. On 8:30 PM, Ravi Shankar Kumar informed by phone to the informant that his brother namely Sri Kant Patel is admitted in Sadar Hospital. Further, when the informant reached Sadar Hospital, he found that his brother namely Sri Kant Patel is lying dead. It is alleged that this information has been given by the present petitioner along with other FIR named accused persons. Similarly situated co-accused persons namely Amit Kumar Singh @ Raja and
