Heard Mr. Ashok Kumar, learned counsel for the petitioner and Mr. Rajiv Nayan, learned APP for the State.

2. Petitioner seeks regular bail in connection with Patliputra P.S. Case No. 591 of 2024 dated 30.12.2024 registered for the offences punishable under sections 331(4) and 305(a) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution story, the informant had gone to Deoghar (Baba Dham) with her family. In the morning of 30.12.2024, the informant received information that the main door of her residence had been burglarized by an unknown thief on the night of 29.12.2024 and upon returning to her residence, the informant found that the lock of the Godrej almirah was broken and all the jewellery, her husband’s licensed pistol with bullets, cash, and other valuables, had been stolen.

The main submissions advanced by petitioner’s counsel are that the petitioner has been languishing in jail since 14.01.2025 and he has been falsely implicated in the present matter of alleged theft and he is not named in the FIR and no incriminating article has been recovered from his possession. It is further submitted that the petitioner has been remanded in the present matter mainly on the basis of confessional statement of Golu Kumar, which has no evidentiary value in the eyes of law.

Learned APP for the State has vehemently opposed the prayer of the petitioner and submits that the petitioner has criminal antecedents of twelve cases and the instant matter relates to the theft of several gold and silver articles along with the informant’s husband’s licensed firearms detailed in the FIR and during the course of investigation the petitioner was apprehended and from his rented room, several gold and silver ornaments as well as lock cutting equipments, were recovered, of which details is mentioned in the seizure list enclosed in the case diary, showing the details of 42 articles having been recovered from the rented room of the petitioner.

6. Considering the petitioner’s long criminal history as detailed by learned APP and also mentioned in the petition, and taking into account the recovery of several incriminating

materials detailed in the seizure list enclosed with the case diary, this Court is not inclined to release the petitioner on bail. Accordingly, his prayer stands rejected.
