2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Tajpur P.S. Case No. 34 of 2022 instituted for the offence under Sections 120B, 385, 387 & 307 of the Indian Penal Code and under Section 25(1-B)1(a), 26, 27 and 35 of the Arms Act.

3. The case of the prosecution is that while the informant’s bus was crossing near Motipur Sabzi Mandi, suddenly five persons on two motorcycle intercepted the bus. It is further alleged that three bullet hit the victim and he was

admitted in the hospital. Further case of the prosecution is that some days back a scuffle took place between staffs of Mahadev Rath bus and the driver of the informant. It is also alleged that ransom of Rupees Two Lakh was demanded from the informant to be paid to the owner fo the bus Mahadev Rath. It is further alleged that there was talk in the town that miscreants were hired for killing the informant.

4. Learned counsel for the petitioners has submitted that from perusal of the FIR it will transpire that there is no specific allegation against any of the petitioners. It has also been submitted by the learned counsel for the petitioners that the person who has received gunshot injuries has filed a compromise petition in the trial court. Learned counsel for the petitioners has submitted that the learned Co-ordinate Bench has granted regular bail to similarly situated accused persons, namely, Dhananjay Kumar, Ranjit Kumar Rai, Prashant Suman and Suman Kumar. It has also been submitted that this case of the petitioners stands on similar footing.

5. Learned APP for the State has vehemently opposed the bail and has submitted that the allegations are against the petitioners.

allegations have been granted regular bail by the learned Coordinate Bench vide Cr. Misc. Case Nos. 33996/2022, 33236/2022, 29167/2022 and 52270/2024, in such circumstances, the petitioners are directed to seek regular bail to maintain unanimity in the order.

7. Having heard learned counsel for the parties and in

the facts and circumstances of the case as stated above, I am not inclined to grant bail to the petitioners.

8. Accordingly, the present bail application stands
