Heard learned counsel for the petitioner and the State.

Petitioner seeks regular bail in a case registered for the offence punishable under sections 399,402, 412 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, acting on a tip off that accused persons are planning for committing come crime, police conducted raid in the house of one Nand Kishore Singh and arrested the petitioner and one of his accomplices, while other accused persons managed to flee away. One automatic country made pistol and two live cartridges were recovered from the pocket of the petitioner.

Learned counsel appearing for the petitioner submits that as a matter of fact, neither petitioner was apprehended on the spot nor any incriminating article has been recovered from the conscious possession of the petitioner rather police has implicated the petitioner in the concocted case only on the basis of the criminal antecedent. Petitioner is in custody since 14.12.2023.
