The petitioners have preferred this application for grant of regular bail in connection with Masaurhi P.S. Case No. 285 of 2025 registered for the offences punishable under Sections 103(1), 61(2) and 238 of BNS.

As per the prosecution story, the informant has alleged that on 06.04.2025, his son went to attend a puja in village Bhadaura where he was invited. He did not return and later it was found that he was strangled to death near Konhra More. Upon investigation, it was revealed that a conspiracy was hatched involving his wife Muskan, mother-in-law Anita Devi, and several others from Bhadaura and nearby villages to

kill the deceased. They murdered him due to family disputes related to his love marriage across caste lines.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case being relative of the wife of the deceased. Petitioner no. 1 is aged about 75 years and petitioner no. 2 is lady who is daughter-in-law of petitioner no. 1. There are general and omnibus allegations have been leveled against these petitioners. They have no concern with the affairs of wife and her deceased husband. No incriminating articles has been recovered from the possession of the petitioners. Learned counsel further submits that in case diary, none has been shown as eye witness of the alleged occurrence. Petitioners are in custody since 08.04.2025 having no criminal antecedent.

Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Keeping in view the aforesaid facts and considering the period under custody as also clean antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S.

Case No. 285 of 2025 subject to the following conditions :-

(i). Petitioners will remain physically present in trial

¶25

on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond

¶26

of the petitioner may be cancelled by the Trial Court.

¶27

(ii). One of the bailor shall be their family member.
