for the State and learned counsel for the informant.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8/12 of the POCSO Act.

The case of the prosecution is that the petitioner has kidnapped the minor sister of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that during investigation, the victim has given her statement under Sections 180 and 183 of the B.N.S.S. wherein she has stated that as her

mother has scolded her, she went to Patna. In her statement recorded under Section 180 of the B.N.S.S., she has stated that she herself has called the petitioner. From perusal of the statement of the victim recorded under Section 183 B.N.S.S., it is also clear that she has solemnized marriage with the petitioner. Learned counsel for the petitioner has further submitted that parties have compromised this case. Moreover, the statement which has been made by the victim under Sections 180 and 183 of BNSS, it is clear that there is no role of this petitioner in taking away the victim to Patna rather she has gone there herself. It is a case of elopement. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 21.02.2025.

Learned APP appearing for the State and learned counsel for the informant are present. Learned counsel for the informant has conceded that both the parties have compromised this case.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
