Heard learned counsel appearing on behalf of the petitioners and learned APP for the State.

The petitioners seek pre-arrest bail in connection with Belhar P.S. Case No. 418 of 2023 registered for the offence punishable under Sections 341, 323, 308, 379, 504 and 506/34 of the Indian Penal Code.

As per the allegation made in the F.I.R., petitioners are said to have assaulted the informant by means of lathi and khanti causing injury on his head and when his wife came in his rescue, they also assaulted her and committed theft of silver chain.

Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have committed no offence as alleged. There is case and counter case between the parties. The injury sustained by the victim is simple in nature. The petitioners have clean antecedent.

Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

Considering the nature of allegation made against the petitioners, learned District Court is directed to verify the injuries attributable to the petitioners and if it is found that the injuries attributable to the petitioners are simple in nature, then the petitioners, above named, be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District Court where the case is pending in connection with Belhar P.S. Case No. 418 of 2023, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.

The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in
