2. Petitioner seeks regular bail in connection with Mirganj P.S. Case No. 22 of 2025 dated 10.02.2025 registered for the offences punishable under Sections 126(2), 115(2), 352, 351(2), 85, 80(2) and 3(5) of the Bharatiya Nayaya Sanhita, 2023 ( in short ‘B.N.S.’) and Sections 3 & 4 of the Dowry Act.

3. The main submissions advanced by petitioner’s counsel are that the petitioner is the father-in-law of the deceased, the FIR itself shows that the main allegation is against the co-accused Soni Devi, Gotni of the deceased who allegedly

called the other six co-accused persons belonging to her naihar and thereafter committed the alleged occurrence, the name of this petitioner finds place in the first part of the prosecution story in which, no specific allegation is made against this petitioner. It is further submitted that seven co-accused persons carrying similar allegation like this petitioner, have been granted anticipatory bail by the learned co-ordinate Bench of this Court vide order dated 07.07.2025 passed in Cr. Misc. No. 40523 of 2025. It is lastly submitted that the husband of the deceased is in the judicial custody.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions and mainly the fact that the petitioner is said to be the father-in-law of the deceased and the main allegation is against the co-accused Soni Devi who happens to be Gotni of the deceased and several coaccused persons out of whom some are carrying similar nature of allegation, are enjoying the privilege of anticipatory bail also, coupled with the petitioner's old age and his custody period, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two
